La futura reforma de la legislación civil en materia de protección de las personas con discapacidad

Abstract

En este trabajo se aborda la futura reforma de la legislación civil en materia de protección de las personas con discapacidad. La discapacidad es una cuestión de alcance global. La Organización de Naciones Unidas es consciente de ello en 2006 a través de la Convención sobre Derechos de las Personas con Discapacidad. En España, muchas personas sufren el problema de la discapacidad. El legislador español responde a los objetivos de la Organización de Naciones Unidas con el Anteproyecto de Ley por la que se reforma la legislación civil y procesal en materia de discapacidad. Mi objetivo es presentar las principales novedades del mismo. Se afronta el cambio del actual sistema dualista de capacidad jurídica y capacidad de obrar a un sistema que aboga por la existencia de una única capacidad jurídica. Se presenta la eliminación de algunas instituciones jurídicas de protección de las personas con discapacidad y la atribución de nuevas funciones a otras. Por su parte, se expone la importancia de la constitución de un sistema de apoyos hacia la persona que sufre una discapacidad. En este trabajo, se van a presentar los principales cambios de la reforma en el ordenamiento jurídico civil español. Estas modificaciones irán acompañadas de mi interpretación y mi voluntad de reflejar la necesidad de que se modifiquen las leyes para la construcción de sociedades más justas.

In this work it is tackled the future reform of the civil legislation in the area of the protection of the persons with disabilities. These are a question of global scope. The United Nations Organization is aware of this in 2006 through the Convention on the Rights of Persons with Disabilities. In Spain, a plethora of people suffer the problem of disabilities. The Spanish legislator responds to the objectives of the United Nations Organization with the Draft Bill by which it is reformed the civil and procedural legislation in the area of disabilities. Mi aim is to present the main novelties of it. The change of the current dualist system of legal capacity and capacity to act to another system that advocates for the existence of a unique legal capacity is confronted. The elimination of some judicial institutions of protection of the persons with disabilities and the designation of new functions to other ones is presented. Furthermore, the importance of the constitution of a system of supports towards the person who suffers any disability is exposed. In this work, the primary changes of the reform in the Spanish civil legal system is going to be presented. These modifications are going to be accompanied by my interpretation and my will to reflect the necessity of the reform of the laws in order to build fairer societies.
