Análisis de los Derechos de los Migrantes. Especial foco en Europa

Abstract

Este trabajo aborda los derechos humanos de los migrantes, los cuales divide entre derechos de los migrantes económicos y derechos de los refugiados. Para dicho estudio se hace un análisis crítico del marco jurídico a existente a nivel internacional, a nivel de la Unión Europea y, finalmente del marco jurídico español. Además, se analiza el origen de los derechos fundamentales de los migrantes bajo la lupa de la filosofía del derecho y, concretamente, desde el punto de vista del Derecho Natural y del Derecho Positivo. Para aportar contexto al trabajo, también se realiza un breve análisis histórico del fenómeno migratorio, en el que se enuncian los principales momentos históricos en los que ha habido un aumento significativo del flujo migratorio y, entrando más en el ámbito histórico-jurídico, se muestra el origen de los derechos de los migrantes, así como se han ido cristalizando en los distintos instrumentos de derecho internacional y cómo han ido filtrándose en los ordenamientos jurídicos nacionales a lo largo del tiempo. Del análisis de este trabajo podemos destacar la evolución progresiva que ha habido en los derechos de los migrantes, la desigualdad existente entre los derechos de los migrantes económicos y los derechos de los refugiados, que se justifica por el estado persecución y extrema necesidad al que se ven sometidos estos últimos.

This paper addresses human rights of migrants, which are divided between the rights of economic migrants and the rights of refugees. For this study, a critical analysis of the existing regulatory framework is done at an international level, at the level of the European Union and, finally, at the level of the Spanish legal system. In addition, the origin of the fundamental rights of migrants is analysed under the scrutiny of philosophy of law and, specifically, from the point of view of Natural Law and Positive Law. In order to provide context to the analysis, a brief historical analysis of the migratory phenomenon is also carried out, which sets out the main historical moments in which there has been a significant increase in the phenomenon of migration, and entering more into the historical-legal sphere, it shows the origin of the rights of migrants, as well as how they have crystallised in the different instruments of international law and how they have filtered into the national legal systems over time. From the analysis of this work we can highlight the progressive evolution that has taken place in the rights of migrants, the existing inequality between the rights of economic migrants and the rights of refugees, that is justified by the state of persecution and extreme need to which the latter are subjected.
