The African and European Courts of Human Rights: Application of Article 6 CEDAW

Abstract

A lo largo de la Historia, la lucha por la protección de los derechos humanos ha sido decisiva para entender las relaciones que se forman hoy en día. Es cierto que ha habido muchas mejoras cuando se habla de derechos humanos, pero no tantas cuando se habla de los derechos de la mujer. En este ensayo, analizaremos el artículo 6 de la Convención sobre la Eliminación de Todas las Formas de Discriminación contra la Mujer (CEDAW), que aboga por la abolición de la prostitución y la trata de mujeres. Su aplicación en los Tribunales Regionales de Justicia es muy importante ya que estos Tribunales son fundamentales en la aplicación uniforme de los Derechos Humanos. Por lo tanto, estudiaremos si el Tribunal Europeo de Derechos Humanos y en la Corte Africana de Derechos Humanos y de los Pueblos están aplicando correctamente el artículo 6 de la CEDAW.

Through History, the fight for the protection of human rights has been crucial in order to understand the relationships shaped nowadays. It is true that there have been many improvements when talking of human rights, but not so many when talking of women’s rights. In this essay, we will analyze article 6 of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), which pushes for the abolition of prostitution and trafficking in women. Its application in the Regional Courts of Justice is very important as this Courts are fundamental in the even application of Human Rights. Therefore, we will study if the European Court of Human Rights and in the African Court on Human and Peoples Rights are applying correctly article 6 of CEDAW.
