Estudio y análisis de la efectividad de la CIJ a través del cumplimiento de sus sentencias

Abstract

La Corte Internacional de Justicia es reconocida como el órgano judicial internacional de mayor relevancia, pero ¿Es ésta verdaderamente efectiva? Desde su creación en 1945 hasta la actualidad, la CIJ se ha pronunciado sobre más de 100 controversias; sin embargo, en reiteradas ocasiones los Estados litigantes no han cumplido con lo dispuesto en las sentencias. En este sentido, el presente trabajo estudia una muestra de casos elevados ante el tribunal, para analizar si las correspondientes sentencias fueron correctamente ejecutadas. Así, el grado de cumplimiento que observemos nos dará una visión real sobre la efectividad de esta institución. Como descubriremos, la CIJ resultará ser un órgano judicial efectivo, aunque sean precisas algunas reformas que fortalezcan el grado de cumplimiento de sus sentencias.

The International Court of Justice is recognized as the most important international judicial body, but is it really effective? Since its creation in 1945 until today, the ICJ has ruled on more than 100 disputes, however, the litigating States have repeatedly failed to comply with the judgments. In this regard, this paper studies a sample of cases brought before the court, to analyze whether the corresponding judgments were correctly executed. Thus, the degree of compliance we observe will give us a real picture of the effectiveness of this institution. As we will discover, the ICJ will prove to be an effective judicial body, although some reforms are needed to strengthen the degree of compliance with its judgements.
