Resumen : | Las obras de arte están presentes en el tráfico jurídico-económico. Circulan, se transmiten, son objeto de inversión, de constitución de garantías, se prestan o ceden. Y cómo todo objeto o res commercium, están sujetas a múltiples riesgos, y cómo no, la autenticidad como riesgo específico de las mismas de cara a la transmisión y su validez. Pese a la creencia primaria y quizás aparente de cierta estaticidad, incluso privacidad, pocos bienes como éstos atesoran tamaña vocación de circulación, amén de su trascendencia y notoriedad pública cuando su valor alcanza cifras exorbitantes. Y lo están con sus riesgos, tanto en su esencia como en su circunstancia, en buena parte a merced de valoraciones que, no pocas veces, escapan a la idiosincrasia de la propia obra. Mas sin duda, son los riesgos de autenticidad de la obra y la adquisición a dominio los dos principales. Indubitar la autenticidad, la originalidad y la atribución a un autor concreto no siempre será sencillo, antes al contrario, imposible en algunos supuestos extremos, pero el derecho debe reaccionar, tutelando tanto el derecho del pretendido adquirente, accipiens, como tutelando el propio mercado del arte a través de un público interés que, finalmente, vela por el patrimonio artístico y por la propia integridad de ese mercado. Tutela o protección civil, con el corolario en algunos extremos de nulidad del negocio jurídico, pero también tutela penal se abrazan en aras de esa protección del patrimonio. Fine art are present in the legal-economic traffic. They circulate, are transmitted, are subject to investment, to the constitution of guarantees, are lent or transferred. And how all object or res commercium, are subject to multiple risks, and how not, the authenticity as specific risk of the same ones in face of the transmission and its validity. Despite the primary and perhaps apparent belief in a certain staticity, even privacy, few goods like these have such a vocation for circulation, in addition to their transcendence and public notoriety when their value reaches exorbitant figures. And they are so with their risks, both in their essence and in their circumstance, largely at the mercy of valuations that, not infrequently, escape the idiosyncrasy of the work itself. But without a doubt, the risks of authenticity of the work and the acquisition of mastery are the two main ones. To doubt the authenticity, the originality and the attribution to a specific author will not always be easy, on the contrary, it will be impossible in some extreme cases, but the law must react, protecting both the right of the pretended acquirer, accipiens, and protecting the art market itself through a public interest that, finally, watches over the artistic heritage and the integrity of that market. Guardianship or civil protection, with the corollary, in some cases, of the nullity of the legal transaction, but also criminal protection, are embraced for the sake of this protection of the heritage. |
