The legal figure of Statelessness and its impact on Fundamental Human Rights

Abstract

Este proyecto consiste en la descripción del concepto de Apatridia y cómo afecta a la protección y el ejercicio de los Derechos Humanos. En primer lugar, defino el concepto de Apatridia e incluyo datos actuales sobre el número de apátridas en el mundo y la evolución de esta cuestión. A continuación, analizo la figura jurídica de la Apatridia en el Derecho Internacional Público, cómo está protegida o regulada por determinados organismos internacionales, y regionales saco conclusiones acerca de qué falta para garantizar una mayor protección de los apátridas. Además, describo las distintas causas que pueden llevar a una persona a no disfrutar del derecho a la nacionalidad, y las principales consecuencias que se derivan de ello y que tienen impacto directo en otros derechos humanos. Finalmente, me centro en un caso concreto para mostrar la relevancia de este problema en la actualidad y la urgencia que existe de mitigar sus consecuencias y erradicar el problema. Con las conclusiones defiendo que asegurar la nacionalidad a todas las personas es uno de los aspectos más importantes que existen en materia de Derechos Humanos, ya que si un individuo no es reconocido por un estado, no goza de ninguna seguridad jurídica, y por tanto es mucho más vulnerable a la violación de numerosos Derechos Humanos.

This project consists of the description of the concept of Statelessness and how it affects the protection and exercise of Human Rights. First, I define the concept of Statelessness and include current data on the number of stateless persons in the world and the evolution of this issue. Next, I analyze the legal figure of Statelessness in Public International Law, how it is protected or regulated by certain international and regional organizations, and draw conclusions about what is lacking to ensure greater protection of stateless persons. In addition, I describe the different causes that can lead a person to not enjoy the right to nationality, and the main consequences that derive from it and that have a direct impact on other human rights. Finally, I focus on a specific case to show the relevance of this problem today and the urgency of mitigating its consequences and eradicating the problem. With the conclusions I argue that ensuring nationality to all people is one of the most important aspects that exist in terms of Human Rights, since if an individual is not recognized by a state, he/she does not enjoy any legal security, and therefore is much more vulnerable to the violation of numerous Human Rights.
