El pasaporte de inmunidad desde la perspectiva del derecho constitucional español

Abstract

En este trabajo vamos a analizar la viabilidad de un pasaporte inmunitario en el Derecho Constitucional Español. Trataremos de responder a si éste vulnera derechos fundamentales de los ciudadanos, como el derecho a la no discriminación, el derecho a la intimidad o el derecho a la salud. Además, estudiaremos ante que situaciones podemos encontrarnos en el ámbito laboral y hasta qué punto llega la línea que separa que actos debemos considerar como discriminación laboral y cuáles debemos considerar como medida de protección y prevención. También versaremos sobre el teletrabajo y cuáles son las leyes actuales que regulan esta modalidad. Finalmente analizaremos situaciones que ya hemos vivido en la historia de la humanidad, para ver de qué formas se solventaron pandemias pasadas y que mecanismos de prevención se asemejan a los actuales. Además, nos apoyaremos en medidas de prevención que ya se encuentran entre nosotros como el Certificado Internacional de Vacunación y que tienen una funcionalidad similar a la pretendida con el Pasaporte Inmunitario o también llamado Pase Verde Digital.

In this study, we are going to analyze the viability of an Immune Passport in Spanish Constitutional Law. We will try to answer whether it violates fundamental rights of citizens, such as the right to non-discrimination, the right to privacy or the right to health. In addition, we will examine what situations we can find ourselves in the workplace and how far goes the line that separates which acts should be considered as discrimination in the workplace and which should be considered as a measure of protection and prevention. We will also deal with teleworking and which are the current laws that regulate this modality. Finally, we will analyze situations that we have already experienced in the history of humanity, to see how past pandemics were solved and what prevention mechanisms are similar to the current ones. In addition, we will rely on prevention measures that are already among us as the International Certificate of Vaccination and that have a similar functionality to that intended with the Immune Passport or also called Digital Green Pass.
