El nuevo régimen económico de las energías renovables

Abstract

España ha asumido ambiciosos objetivos de producción de energía renovable, para alcanzar estas metas se ha habilitado el régimen económico de energías renovables que faculta la celebración de subastas de producción de energía renovable que garantizan un precio por electricidad producida.

A lo largo de este trabajo se expondrán cuales son las fortalezas y debilidades de los sistemas de subasta de energía a nivel general, así como las diferentes tipologías de mecanismos de subasta, para, después, hacer un estudio pormenorizado y crítico de los instrumentos normativos que han llevado a la implementación del régimen económico de energías renovables en España: el Real Decreto 960/2020, la Orden TED/1161/2020 y la Resolución de 12 de diciembre de 2020 por la que se convoca la primera subasta, única convocada bajo este marco normativo hasta la fecha. Se tendrá en consideración para realizar este análisis, informes de organizaciones internacionales y de la CNMC, así como las opiniones del sector de energías renovables y de reputados expertos en la materia. En última instancia, se analizarán los resultados de la primera subasta convocada y su impacto económico y medioambiental.

A través de este estudio se comprobará la utilidad de las subastas como mecanismo de fomento de la producción de energías renovables si bien se demostrará que no es un sistema perfecto y presenta limitaciones. No obstante, a pesar de estas limitaciones insalvables se expondrán fallos en el diseño elegido por el regulador español que deberían ser evitados.

Spain has assumed ambitious renewable energy production targets, to achieve these goals has enabled the economic regime of renewable energy that enables the holding of renewable energy production auctions that guarantee a price for electricity produced.

Throughout this paper, the strengths and weaknesses of energy auction systems at a general level will be presented, as well as the different types of auction mechanisms, to then make a detailed and critical study of the regulatory instruments that have led to the implementation of the renewable energy economic regime in Spain: Royal Decree 960/2020, Order TED/1161/2020 and the Resolution of December 12, 2020, which calls for the first auction, the only one called under this regulatory framework to date. In order to carry out this analysis, reports from international organizations and the CNMC will be taken into consideration, as well as the opinions of the renewable energy sector and renowned experts in the field. Ultimately, the results of the first auction and its economic and environmental impact will be analyzed.

This study will prove the usefulness of auctions as a mechanism to promote the production of renewable energies, although it will demonstrate that it is not a perfect system and has limitations. However, despite these insurmountable limitations, it will expose flaws in the design chosen by the Spanish regulator that should be avoided.
