La legítima en el Código Civil español: ¿una institución intocable?

Abstract

Libertad de testar o limitación de la disposición mortis causa de los bienes: una tradicional polémica sin respuesta en el ordenamiento jurídico español. El presente trabajo de investigación tiene como propósito embarcarse en este debate, con el fin de adaptar el sistema sucesorio actual a la realidad del siglo XXI. No es tarea sencilla, pero para ello será necesario entender en primer lugar qué son las legítimas y cómo funcionan.

Freedom of inheritance or the limitation of the mortis causa disposition of assets? A traditional unanswered controversy in the Spanish Legal System. The purpose of this research work is to embark on this debate, with the aim of bringing the current inheritance system to the realities of the 21st century. It’s not a simple feat as it requires previous knowledge on both what legitimacies are and how they work.
