La invisibilidad de los niños inmigrantes: Cuestiones en torno al derecho a la identidad y la documentación

Abstract

Los mecanismos de protección jurídica ofrecidos por el Estado español presentan varias deficiencias a la hora de salvaguardar los derechos básicos de los menores migrantes que llegan a sus puertas. En concreto, teniendo en cuenta que la mayoría no llega con la documentación apropiada para identificarse, se profundiza en qué problemas enfrenta este colectivo especialmente vulnerable en términos de su derecho a una identidad y a la documentación pertinente para hacerla valer.

The legal protection mechanisms offered by the Spanish State have several shortcomings when it comes to safeguarding the basic rights of migrant minors who arrive on its doorstep. In particular, taking into account that most of these minors do not arrive with the appropriate documentation to identify themselves, this Thesis delves into the problems faced by this particularly vulnerable group in terms of their right to an identity and the relevant documentation to assert it.
