Sesgos cognitivos en la toma de decisiones judiciales

Abstract

El propósito de este trabajo es hacer una revisión de la bibliografía reciente sobre el efecto de los sesgos cognitivos en las decisiones judiciales. Para ello explicaremos cómo operan los sesgos cognitivos en la toma de decisiones y ofreceremos ejemplos en ámbitos judiciales para ilustrar cómo afectan a la fiabilidad de estos procesos. En concreto, se analiza el sesgo de representatividad, el sesgo de anclaje y ajuste, el sesgo retrospectivo, el sesgo de grupo, el sesgo de disponibilidad y el sesgo de confirmación. Por otro lado, abordaremos las diferentes influencias que afectan a la toma de decisiones judiciales, como las expectativas e ideas preconcebidas y veremos que soluciones se han encontrado para disminuir el efecto de los sesgos.

The aim of this paper is to make a review of the recent bibliography on the effect of cognitive biases in judicial decisions. To do this, we will explain how cognitive biases operate in decision-making and we will give examples in judicial settings to illustrate how they affect the reliability of these processes. Specifically, we analyze representativeness bias, anchoring bias, retrospective bias, group bias, availability bias, and confirmation bias. On the other hand, we will address the different influences that affect judicial decision-making, such as expectations and preconceptions, and we will see what solutions have been found to reduce the effect of biases.
