El error vicio del consentimiento

Abstract

El presente trabajo de investigación trata el error vicio del consentimiento en la formación de los contratos, su regulación, y la opinión doctrinal y jurisprudencial al respecto. Debido a que la regulación del error vicio del consentimiento en el Código Civil es escasa, ha sido necesario realizar un análisis exhaustivo de la jurisprudencia del Tribunal Supremo para poder profundizar en el concepto de error, los presupuestos para su relevancia, los tipos de error vicio, y sus consecuencias jurídicas. Así, es posible afirmar que respecto al error en el consentimiento el Tribunal Supremo ha desempeñado una función recreadora, interpretando los preceptos del Código Civil, completándolos y adaptándolos a las necesidades del tráfico jurídico.

This paper analyses the error as a defect in the formation of contracts, its regulation, and the doctrine and jurisprudence’s opinion on the matter. Due to the scarce regulation in the Civil Code of the error, it has been necessary to conduct a comprehensive review of the Supreme Court’s decisions on the matter in order to deepen into the concept of error, the requirements for its relevance, the error types, and its legal implications. Thus, it can be stated that regarding the error in the consent, the Supreme Court has play a re-creative function, not only interpreting the provisions of the Civil Code, but also supplementing and adapting them to the needs of the legal relations.
