El arbitraje de consumo en el sector bancario y financiero

Abstract

Mediante el presente trabajo se aborda la conveniencia de un desarrollo y sustento de la especialización del arbitraje como sistema alternativo para la resolución ordenada de conflictos en materia preeminentemente bancaria y financiera. A tal efecto, primeramente, se despliega la contextualización del sector que hace necesaria la implementación de la especialidad. En segundo lugar, se realiza un análisis pormenorizado de las disposiciones normativas aplicables al procedimiento, sin olvidar aquellos rasgos caracterizadores del Sistema Arbitral de Consumo. Por último, se sugieren materias y casos concretos susceptibles de ser sometidos al proceso arbitral, prestando especial interés en el Arbitraje de las Participaciones preferentes

Through this work, is analyzed the advisability of developing and supporting of specialization of arbitration as an alternative system for the orderly resolution in banking and financial matters pre-eminently. To that effect, firstly, is displayed a contextualization of the sector that requires the implementation of the specialty. Secondly, is developed a detailed analysis of the regulatory provisions applicable to the proceedings, not forgetting the characterizing features of the Consumer Arbitration System. Finally, we suggested specific matters and cases that could be submitted to arbitration, with particular interest in the arbitration of the Preference Shares.
