La función social del abogado

Abstract

La importancia de la figura de los abogados en la sociedad, como función social que desempeñan junto con otros operadores jurídicos, ha sido la impulsora de este estudio, que pretende analizar cómo a través de la creación de los Códigos Deontológicos hace que la sociedad confíe en ese colectivo, los abogados, que se guían por unos principios o conductas éticas. Para ello previamente se hará un análisis exhaustivo del sistema jurídico español, como Estado Constitucional, en el que la sentencia y la ley serán nuestras fuentes más importantes y se concluirá, con la importancia que representa para el abogado, el lenguaje y la expresión jurídica como medio de persuasión.

The importance of the role of lawyers in society, understood as a social role that they play together with other legal operators, has been the driver of this study. This paper aims at analysing how the creation of Codes of Good Conduct make society trust this collective group – the lawyers- that are guided by certain principles or ethical rules. To reach this objective, first we will do an exhaustive study of the Spanish legal system, as a Constitutional State, in which judgements and law will be our most important sources. It will conclude with the importance for lawyers that the language and legal expression have as a means of persuasion.
