Sine proprio. Estudio histórico-jurídico del voto de pobreza de los religiosos

Abstract

Casi desde los orígenes mismos del Cristianismo, y hasta nuestros días, han surgido dentro del mismo hombres y mujeres llamados a vivir su fe en una forma de vida marcada por una peculiar relación con los bienes temporales, con las riquezas: han sido y son los consagrados, los monjes y monjas, los religiosos y las religiosas. La influencia de la vida monástica y de las órdenes y congregaciones religiosas a lo largo de los siglos, hasta nuestros días, se extiende a todos los ámbitos de la vida social, económica y cultural. Asumida esta vocación por la Iglesia en un estado público de vida, a lo largo de la historia de la Iglesia ha regulado con precisión la relación de estas personas con sus bienes. Desde los primeros textos normativos cristianos hasta el Código de Derecho Canónico de 1983, pasando por las reglas de los Padres del Desierto y los grandes Padres fundadores, así como algunos de los grandes concilios, la Iglesia ha ido elaborando una normativa específica, un derecho, para encauzar y dar expresión jurídica a la voluntad de desposesión bienes de los religiosos y religiosas. Y no solo la Iglesia, durante siglos (hasta finales del siglo XIX en nuestro entorno cultural europeo-occidental) también los Estados han venido legislando sobre el específico estatuto patrimonial de los religiosos y religiosas, en un modo no siempre concorde con la normativa canónica, baste mencionar la polémica cuestión de la «muerte civil» de los religiosos. En esta obra se ofrece un estudio histórico-jurídico del peculiar estatuto jurídico-patrimonial, canónico y civil, de los religiosos a lo largo de su historia, o, dicho con otras palabras, una aproximación a los orígenes y evolución del derecho del voto de pobreza, en sus expresiones canónica y civil, a lo largo de su historia. Historiadores, juristas, canonistas, teólogos y, en general, todos los interesados en profundizar en el conocimiento del voto de pobreza de los religiosos y religiosas encontrarán en esta obra una valiosa ayuda.

Almost from the very origins of Christianity to the present day, men and women have arisen within it who have been called to live their faith in a way of life marked by a particular relationship with temporal goods, with riches: they have been and are the consecrated, the monks and nuns, the religious men and women. The influence of monastic life and of religious orders and congregations throughout the centuries, up to the present day, extends to all areas of social, economic and cultural life. Once this vocation was assumed by the Church in a public state of life, throughout the history of the Church it has precisely regulated the relationship of these persons with their goods. From the first Christian normative texts to the 1983 Code of Canon Law, passing through the rules of the Desert Fathers and the great founding Fathers, as well as some of the great councils, the Church has been elaborating a specific norm, a law, to channel and give juridical expression to the will of dispossession of goods of religious men and women. And not only the Church, for centuries (until the end of the 19th century in our western European cultural environment) also the States have been legislating on the specific patrimonial status of religious men and women, in a way not always in accordance with canonical norms, suffice it to mention the controversial question of the "civil death" of religious men and women. This work offers a historical-legal study of the peculiar juridical-patrimonial, canonical and civil status of religious throughout their history, or, in other words, an approach to the origins and evolution of the right to the vow of poverty, in its canonical and civil expressions, throughout their history. Historians, jurists, canonists, theologians and, in general, all those interested in deepening their knowledge of the vow of poverty of religious men and women will find in this work a valuable aid.
