Herramientas de la UE para garantizar el Estado de derecho : los derechos LGBT en Polonia y Hungría

Abstract

Durante las últimas décadas, la Unión Europea ha experimentado una gran división entre sus Estados Miembros respecto a cuestiones clave como la concepción de sus valores y principios más básicos, que son interpretados de maneras diferentes en algunos de los Estados que conforman la Unión. En concreto, en este trabajo, se analizarán los casos de Polonia y Hungría, y del tratamiento que los gobiernos de estos países dan a los derechos y libertades de las minorías sexuales de sus respectivas sociedades. Posteriormente se llevará a cabo una reflexión sobre la validez y la eficacia de las actuales herramientas de las que dispone la UE para garantizar el Estado de derecho en todo su territorio, y finalmente se explorará la necesidad y la posibilidad de incluir nuevas herramientas que permitan lograr este objetivo.

During the last decades, the European Union has experienced a great division among its Member States with regard to some key issues such as the understanding of its most basic values and principles, which are understood in different ways by some of the States that belong to the Union. In particular, this article will analyse the cases of Poland and Hungary, and how the governments of these two countries address the rights and liberties of the sexual minorities in their respective societies. Subsequently, a reflection will be carried out on the validity and effectiveness of the current tools held by the EU in order to guarantee the rule of law within its territory, and finally, it will be discussed the necessity and possibility of including new tools that allow this goal to be achieved.
