El Gabinete del Presidente del Gobierno : ¿un órgano asesor del Presidente o un Consejo de Ministros en la sombra?

Abstract

El Gabinete de la Presidencia del Gobierno es el círculo más cercano a la toma de decisiones del Presidente del Gobierno. No se puede entender su configuración actual sin antes detenerse en las múltiples distribuciones que han hecho los Presidentes de la época democrática. También cobra especial relevancia la doctrina administrativa que justifica la existencia de agentes, ajenos a la Administración, que trabajan asesorando y ejerciendo labores de apoyo a una persona que lidera la misma.

Su creciente relevancia y capacidad de influencia en la cúspide de la Administración General española exige un análisis de los distintos órganos que forman parte del Gabinete de la Presidencia del Gobierno. También se profundiza en las obligaciones asumidas, especialmente en aras de la transparencia y el buen gobierno, por las personas titulares de los múltiples altos cargos, así como de los requisitos para el nombramiento de las personas que rodean al Presidente, y las consecuencias derivadas de su cese.

En el marco de una creciente repercusión de este tipo de Gabinetes en todos los lugares del mundo, se analizan tres de los gabinetes con más trayectoria y relevancia internacional, como son los casos de Estados Unidos, Reino Unido y Francia, tres modelos de Estado bien distintos.

The President’s Cabinet is the closest circle in the decision-making process of the President. It would be hard to understand the actual setting without previously analyzing the multiple distributions designed by the previous Presidents in the democratic era. Also, it is highly important the administrative doctrine that justifies the existence of agents, who are not members of the Administration, who work advising and doing support activities to the person who leads it.

Its growing relevance and ability to influence at the top of the Spanish General Administration requires an analysis of the different bodies that are part of the Cabinet of the Presidency of the Government. It also deepens into the obligations assumed, especially for the sake of transparency and good governance, by the holders of the multiple high positions, as well as the requirements for the appointment of the people surrounding the President, and the consequences derived from the termination of their mandate.

Within the framework of a growing repercussion of this type of Cabinets in all parts of the world, three of the cabinets with the most experience and international relevance are analyzed, such as the cases of the United States, the United Kingdom and France, three quite different models of State.
