La Unión Europea frente a las vulneraciones del estado de derecho y sus valores fundamentales en Polonia y Hungría

Abstract

Las vulneraciones de los valores fundamentales de la Unión Europea por parte de Hungría y Polonia hacen que la Unión Europea se enfrente a la mayor crisis del Estado de Derecho de su historia. Desde la llegada al poder de partidos como Fidesz y Libertad y Justicia (PiS), se han tomado desde el Gobierno húngaro y polaco medidas de corte iliberal centradas en el control del poder judicial.

En este trabajo de investigación se estudia la manera en la que la Unión Europea se ha enfrentado a las vulneraciones de sus valores fundamentales por parte de ambos países. Para ello, se analizan los valores fundamentales de la Unión desde un punto de vista conceptual, para después desarrollar las vulneraciones de dichos valores llevadas a cabo por países distintos de Polonia y Hungría –notablemente Francia y Rumanía. Después, se estudian en detalle las medidas tomadas en Hungría y Polonia, haciendo especial hincapié en aquellas que atañen a la independencia judicial. Finalmente, se analizan los diversos instrumentos con los que cuenta la Unión para enfrentarse a la vulneración de sus valores fundamentales por parte de Estados miembros. En concreto, se analizan los procedimientos preventivo y sancionador del art.7 TUE, el Mecanismo de Estado de Derecho, el procedimiento de infracción y el Reglamento 2020/2092 sobre un régimen general de condicionalidad para la protección del presupuesto de la Unión.

The violations of the fundamental values of the European Union by Hungary and Poland are making the European Union face the greatest rule of law crisis in its history. Since the coming to power of illiberal parties such as Fidesz and Freedom and Justice (PiS), the Hungarian and Polish governments have taken illiberal measures focused on the control of the judiciary.

This research work studies the way in which the European Union has faced the violations of its fundamental values by both countries. To this end, the fundamental values of the Union are analyzed from a conceptual point of view, and then the violations of these values by countries other than Poland and Hungary - notably France and Romania - are developed. Subsequently, the measures taken in Hungary and Poland are studied in detail, with particular emphasis on those concerning judicial independence. Finally, the various instruments available to the European Union to deal with infringements of its fundamental values by Member States are analyzed. More specifically, the preventive and sanctioning procedures of Article 7 TEU, the Rule of Law Mechanism, the infringement procedure and Regulation 2020/2092 on a general regime of conditionality for the protection of the Union budget are analysed.
