Sistema de voto y circunscripciones electorales en la antigua Roma y en España. Análisis comparativo.

Abstract

El presente trabajo analiza el sistema de voto y las circunscripciones en la antigua Roma y en España. También pretende hacer entender cómo a lo largo de la historia las personas hemos ido adquiriendo más libertades y derechos y entre ellos el derecho a elegir a nuestros representantes. El trabajo lo he estructurado en dos partes. La primera trata sobre Roma. Expongo las etapas tanto históricas como del Derecho en Roma, las magistraturas que conformaban el cursus honorum en detalle y los diversos tipos de comicios que han existido y cómo se tomaban las decisiones. Además, explico cómo eran las circunscripciones dependiendo de los comicios y cómo la población, dividida en circunscripciones elegía a ciertas magistraturas. Es importante ver los cargos políticos que existían entonces para poder ver algunas similitudes con algunos de hoy en día. Muchos han desaparecido pero las funciones desarrolladas siguen siendo realizadas a día de hoy. En la segunda parte del trabajo presento cómo funciona el sistema electoral en España, las circunscripciones que hay en España, cómo se reparten los escaños y los diversos tipos de elecciones que se llevan a cabo en nuestro país tanto a nivel nacional, autonómico como provincial o local. Considero de especial relevancia ver las diferencias entre ambos sistemas y cómo ha ido evolucionando el derecho electoral a lo largo de los años. El Derecho romano se utilizó durante un espacio determinado en el tiempo, pero muchísimos sistemas legales hoy en día han sido influidos en mayor o menor medida por este Derecho. Las fuentes que he utilizado han sido han sido libros de grandes personalidades dentro del Derecho como Fernández de Buján o en la política como Ignacio de Astarloa. Además, he utilizado legislación española para apoyar mis argumentos y diversas revistas y documentación escrita por, en mayoría, catedráticos de Derecho romano o constitucional.

This paper aims to analyze the voting system and constituencies in ancient Rome and in Spain. It also aims to make people understand how throughout history we have been acquiring more freedoms and rights and among them the right to elect our representatives. I have structured the paper in two parts. The first deals with Rome. I explain the historical and legal stages in Rome, the magistracies that made up the cursus honorum in detail and the different types of elections that existed and how decisions were made. In addition, I explain how the constituencies were depending on the elections and how the population, divided into constituencies, elected certain magistracies. It is important to see the political offices they held back then in order to see some similarities with some of today. Many have disappeared but the functions performed are still being carried out today. In the second part of the paper I present how the electoral system works in Spain, the constituencies that exist in Spain, how the seats are distributed and the various types of elections that are held in our country both at national, regional and provincial or local level. I consider of special relevance to see the differences between the two systems and how electoral law has evolved over the years. Roman law was used for a certain period of time, but many legal systems today have been influenced to a greater or lesser extent by this law. The sources I have used have been books of great personalities within the Law such as Fernández de Buján or Ignacio de Astarloa. In addition, I have used Spanish legislation to support my arguments and various journals and documentation written by, mostly, professors of Roman or Constitutional Law.
