Los retos tecnológicos del sistema notarial y registral

Abstract

La irrupción de las nuevas tecnologías ha transformado nuestra sociedad y ha tratado de agilizar y facilitar los trámites que llevamos a cabo en el día a día. Una de las tecnologías que ha irrumpido con más fuerza en los últimos años ha sido, sin duda, blockchain o la tecnología de registro distribuido. Una tecnología que aboga por los valores de inmutabilidad, inmediatez, seguridad, anonimato y descentralización y que tiene múltiples aplicaciones. Actualmente, su implantación y acogida están incrementando de forma continua. Esta tecnología supone un reto a nivel regulatorio para el poder legislativo y una oportunidad como tecnología al servicio de la ley. Uno de los ámbitos de aplicación de esta tecnología es el de los derechos reales y el sistema notarial y registral, que puede beneficiarse de las nuevas tecnologías para incrementar la seguridad del tráfico jurídico. El objeto del presente Trabajo de Fin de Grado es el estudio de las posibles aplicaciones de la tecnología blockchain en este ámbito, su viabilidad y su posible contribución al incremento de la seguridad jurídica, así como el análisis de la implicación de notarios y registradores en el control de legalidad de las transacciones ejecutadas a través de smart contracts que tengan como objeto derechos reales sobre activos inmobiliarios tokenizados, cuestión que está proliferando con fuerza en la actualidad.

The emergence of new technologies has transformed our society and has tried to streamline and facilitate the procedures we carry out on a daily basis. One of the technologies that has burst onto the scene with the greatest force in recent years has undoubtedly been blockchain or distributed ledger technology. A technology that advocates the values of immutability, immediacy, security, anonymity and decentralization and that has multiple applications. Currently, its implementation and acceptance are increasing steadily. This technology represents a regulatory challenge for the legislative power and an opportunity as a technology at the service of the law. One of the areas of application of this technology is that of real rights and the notarial and land registry system. A system that can benefit from new technologies to increase the security of legal transactions. The purpose of this Final Degree Project is to study the possible applications of blockchain technology in this field, its viability and its possible contribution to increasing legal security, as well as to analyze the involvement of notaries and land registrars in the control of the legality of transactions executed through smart contracts involving real rights over tokenized real estate assets, issue that is currently proliferating strongly.
