El testamento de la persona con discapacidad : nueva regulación

Abstract

El objeto del presente Trabajo de Fin de Grado consiste en estudiar el acto de otorgar testamento por quienes padezcan una enfermedad tras los cambios legislativos introducidos por la Ley 8/2021. Para ello, se llevará a cabo un análisis de los artículos 662 a 709 del Código Civil en su redacción anterior y posterior a la entrada en vigor de dicha ley. En este sentido, se pretende dar explicación a los dos principales resultados a los que se ha llegado en este TFG: la amplia posibilidad de otorgar testamento que se le brinda a quienes tienen una discapacidad y la gran responsabilidad que le queda atribuida al Notario a la hora de valorar la capacidad del testador.

The purpose of this paper is to study the act of granting a will by those who suffer from a disease after the legislative changes introduced by Law 8/2021. For this purpose, an analysis will be made of articles 662 to 709 of the Civil Code in its wording before and after the entry into force of such law. In this sense, the aim is to provide an explanation for the two main results that have been reached in this dissertation: the wide possibility of granting a will to those who have a disability and the great responsibility that is attributed to the Notary when assessing the capacity of the testator.
