La regulación de las instituciones de guarda en el Código civil tras su reforma por la Ley Orgánica 8/2021, de 4 de junio

Abstract

Presentamos una revisión de la Ley Orgánica 8/2021 de 4 de junio de Protección Integral a la Infancia y la Adolescencia frente a la Violencia, y la incidencia de sus modificaciones en el Código Civil. Se examinará la reforma del régimen de la patria potestad (en concreto, la reforma del artículo 154 CC, el refuerzo del derecho de las personas menores de edad a ser oídas y escuchadas, sobre la decisión acerca del cambio del lugar de residencia de las personas menores de edad, y la reforma del artículo 158 CC), la reforma del régimen de guarda y custodia en los supuestos de crisis matrimoniales y la reforma de la tutela administrativa de las entidades públicas.

We present a review of Organic Law 8/2021 of 4 June on the Comprehensive Protection of Children and Adolescents against Violence, and the impact of its amendments on the Civil Code. We will examine the reform of the parental authority regime (specifically, the reform of article 154 CC, the reinforcement of the right of minors to be heard and listened to, on the decision on the change of place of residence of minors, and the reform of article 158 CC), the reform of the guardianship and custody regime in cases of marital crisis and the reform of the administrative guardianship of public entities.
