Derecho administrativo: el servicio público al amparo del Derecho francés

Abstract

A nivel europeo y en particular a nivel español, la noción de servicio público y sus conceptos intrínsecos han sido y siguen siendo influenciados por su origen en el derecho administrativo francés. No solo desde el derecho administrativo en sí, sino también de por matices históricos, culturales y políticos, resulta imprescindible la comprensión de estos últimos de cara a entender el funcionamiento del servicio público español. Más allá de la famosa sentencia Blanco, el impacto de la extensa jurisprudencia francesa se despliega desde la conceptualización del servicio público hasta su privatización, pasando necesariamente por su gestión y su encuadramiento legal. Se trata de analizar los aspectos en los que el derecho administrativo español se encontró notablemente influenciado, o no, por el francés. Aun cuando resulte destacable su influencia, procede examinar los aspectos de los que España se descartó e innovó. No pretende limitarse a una mera puesta en relación descriptiva de ambos sistemas administrativos. Más bien, se criticará oportunamente la eficacia de las divergencias contempladas. Especial atención se dedica al rol de evolución histórica y política de la privatización tan en España como en Francia. Concretamente, se observa la orientación política y administrativa de ambos países, así que las distintas oportunidades que se presentan como respuesta jurídica a la última pandemia, con perspectiva a sus próximas elecciones.

At European level and in particular at Spanish level, the notion of public services and its inherent concepts have been and still are influenced by its origin in the French administrative law. Not only from the administrative law perspective, but also considering historical, cultural and political nuances, the comprehension of the latest is essential to understand the Spanish public service's functioning. Over and above the Blanco case law, the French extensive jurisprudence’s impact spreads from the conceptualization to the privatization, necessarily passing by the management and the legal framework. The following analysis will examine the aspects in which the Spanish administrative law was clearly, or not, influenced by the French one. Even when the influence of the latest is remarkable, Spain, in some points, ruled out and innovated. This study doesn’t pretend to stick to a mere descriptive comparison of both administrative legal systems. More precisely, it will consist in an opportune critique of the efficiency of the stated discrepancies. Special attention has to be dedicated to the role of the historical and political evolution of the privatization both in Spain and France. Concretely, the political and administrative orientation of both country will be enlightened, as much as the various opportunities arising as a lawful response to the pandemic, vis-à-vis their future elections.
