De la memoria histórica a la memoria democrática

Abstract

La llegada de la democracia a España así como su entrada en la Unión Europea llevan a la repetida revisión y consiguiente adaptación del ordenamiento jurídico a las circunstancias y demandas sociales del momento. Es así, como en 2007 llega la Ley Orgánica 52/2007, de 26 de diciembre, también conocida como la Ley de Memoria Histórica y, en 2021, el Proyecto de Ley de Memoria Democrática. Previo un estudio preliminar de tres binomios convergentes en las leyes de la memoria (memoria-historia, verdad-democracia, y amnistía-indulto), se realizará un análisis lege data y lege ferenda de las mismas. Este estudio sistemático será completado con la presentación de las repercusiones y estado de opinión respecto de estas leyes. Repercusiones que dejarán entrever la afinidad social hacia ellas y permitirán reflexionar sobre su verdadero alcance y necesidad dentro la sociedad española contemporánea. Se incorporará además una breve aproximación teórico-práctica a la instrumentalización de la memoria en el Estado de Israel, que facilite una imagen sucinta de la importancia de la memoria y sus manifestaciones dentro del país.

The arrival of democracy in Spain and its entry into the European Union led to the periodic revision and subsequent adaptation of the legal system to the circumstances and social demands of the moment. As a result, in 2007 the Ley Orgánica 52/2007, de 26 de diciembre, also known as the Law of Historical Memory, was passed and, in 2021, so was the Proyecto de Ley de Memoria Democrática. After a preliminary study of three converging binomials in memory laws (memory-history, truth-democracy, and amnesty-indult), a lege data and lege ferenda analysis will be carried out. This systematic review will be completed with the presentation of the repercussions and state of opinion concerning these laws. The repercussions will reveal the social affinity towards them and will allow to reflect on their true scope and necessity within the present-day Spanish society. In addition, a brief theoretical-practical approach to the instrumentalization of memory in the State of Israel will be included, providing a succinct overview of the importance of memory in the State and its manifestations within the country.
