El secreto de las comunicaciones en el proceso penal

Abstract

Las cuestiones discutidas en este trabajo son el derecho al secreto de las comunicaciones en el marco constitucional y su vulneración. Se profundizará en el supuesto de su vulneración para poder centrar la atención en la intervención de las comunicaciones como excepción a este derecho, ubicando este tipo de medidas en el proceso penal. Dentro de la injerencia del secreto de las comunicaciones, van a ser claves la regulación, los requisitos necesarios y los hallazgos casuales. En concreto, se van a explicar las intervenciones telefónicas, haciendo referencia a sus aspectos procesales y a la ilegalidad de las pruebas; y se hará una breve alusión a las intervenciones en Internet. Igualmente, va a tener gran relevancia la jurisprudencia desarrollada al respecto por los Tribunales Supremo y Constitucional, y el Tribunal Europeo de Derechos Humanos (TEDH).

The issues discussed in this paper are the right to secrecy of communications in the constitutional framework and its infringement. The case of infringement will be studied in depth in order to focus the attention on the communication intervention as an exception to this right, locating these kind of measures in the criminal process. Within the interception, it will be fundamental the regulation, the necessary requirements and the incidental findings. Specifically, it will be explained the telephonic interventions, making reference to their procedural aspects and the illegality of the evidence; and it will be done a brief summary about the interventions on the Internet. It will be so relevance as well, the jurisprudence developed by the Supreme and Constitutional Court of Justice, and the European Court of Human Rights (ECHR).
