La jubilación activa y el trabajo autónomo

Abstract

La jubilación activa constituye una institución que ha arraigado especialmente en el Régimen Especial de los Trabajadores Autónomos. Se trata de una actuación del legislador encaminada a preservar el propio sistema de la Seguridad Social: por un lado, mediante la promoción del denominado envejecimiento activo, mediante la compatibilidad de pensión y de los resultados de la actividad profesional y, por otro lado, promociona el mantenimiento del empleo de aquellos trabajadores que verían extinguidos sus contratos por la jubilación “a secas” del empleador.

Active retirement is an institution that has taken root especially in the Special Regime for Self-Employed Workers. It is an action of the legislator aimed at preserving the Social Security system itself: on the one hand, by promoting the so-called active aging, through the compatibility of pension and the results of the professional activity and, on the other hand, it promotes the maintenance of employment of those workers who would see their contracts terminated by the employer's "simple" retirement.
