Deontología jurídica en clave aristotélica

Abstract

Nos encontramos en un Estado Social y Democrático, dónde el derecho es utilizado como mecanismo, instrumento o vía. En manos de Zagrebelsky podremos analizar la crisis de la democracia contemporánea. En este trabajo vamos a centrar el punto de atención en los abogados junto con ese “deber ser justo” que deben cumplir en su ejercicio profesional. Teniendo a Aristóteles como referente podremos ver una diferente perspectiva a la hora de comparar el sistema actual. Además, plantearnos si puede existir algún reflejo aristotélico en la deontología jurídica de la abogacía española. En primer lugar, recordaremos la base de la deontología y los valores más característicos de la filosofía de Aristóteles. A posteriori, continuaremos con un análisis de algunos principios del Código Deontológico de la Abogacía Española, podremos extraer la esencia que les caracteriza al intentar orientar al abogado para que realice su ejercicio profesional de la manera más justa. Esa esencia, la analizaremos desde una perspectiva aristotélica. Finalmente, concluiremos con el jurista virtuoso que promociona Aristóteles. Con ello esperamos cumplir con el reto de un trabajo de fin de grado de filosofía jurídica: pensar el actual contexto jurídico para conocerlo mejor y expresar, en su caso, las deficiencias u otras posibilidades.

We are in a Social and Democratic State, where the right is used as mechanism, instrument or route. In Zagrebelsky's hands we will be able to analyze the crisis of the contemporary democracy. In this work we are going to focus the point of attention on the attorneys together with this "to must be just" that must expire in his professional exercise. Taking Aristotle as a modal we will be able to see a different perspective at the moment of comparing the current system. In addition, if some Aristotelian reflection can exist in the juridical business ethics of the Spanish law. First, we will remind the base of the business ethics and the values most typical of Aristotle's philosophy. Afterwards, we will continue with an analysis of some principles of the Code of professional ethics of the Spanish Law, will be able to extract the essence that characterizes them on having tried to orientate the attorney in order that it realizes his professional exercise of a most just way. This essence will be analyzed it from an aristotelian perspective. Finally, we will conclude with the virtuous jurist that Aristotle promotes. With it we wait to expire with the challenge of a work of purpose of degree of juridical philosophy: to think the current juridical context to know it better and to express, in his case, the deficiencies or other possibilities.
