Abstract

En el presente Trabajo de Fin de Máster, se ha llevado a cabo un análisis pormenorizado del caso práctico en cuestión. En concreto, se han tratado las cuestiones de incumplimiento contractual del artículo 1124 del Código Civil, la institución jurídica de saneamiento por vicios ocultos, la cláusula rebus sic stantibus con sus problemáticas específicas derivadas de la pandemia del Covid-19, además de cuestiones de competencia desleal. Para ello, se han examinado la jurisprudencia relevante y las opiniones de la doctrina científica al respecto, hasta llegar a las conclusiones que se han considerado oportunas.

The aim of this Master’s Thesis is to perform a detailed analysis of the practical case in question. Specifically, we have dealt with the following matters: breach of contract of article 1124 of the Spanish Civil Code, the legal institution of remedy for hidden defects, the rebus sic stantibus clause with its specific problems arising from the Covid-19 pandemic, as well as issues of unfair competition. For this purpose, the relevant case law and the opinions of the scientific doctrine on the subject have been examined, until reaching the consequent conclusions that have been considered appropriate.
