Abstract

Este trabajo consiste en el escrito de interposición de un recurso contencioso-administrativo por parte de la empresa concesionaria Túnel de Teide S.A., contra el Acuerdo de Rescate de esa concesión administrativa adoptado por el Cabildo Insular de la isla de Tenerife. Este escrito incluye también en el Otrosí la solicitud de adopción de una medida cautelarísima o, subsidiariamente, la medida cautelar. Esta solicitud se basa en evitar unos perjuicios irreversibles como consecuencia de la ejecutividad inmediata del Acuerdo de Rescate, que ni la futura estimación favorable del recurso podría reparar. En todo caso, se analizan y desarrollan los tres requisitos que deben concurrir para que pueda acordarse una medida cautelar.

This writing focuses on filling a contentious-administrative appeal by the concessionaire company Túnel de Teide S.A., against the Agreement adopted by the Cabildo Insular of Tenerife on 31th July 2021, by which they rescue the concession for reason of public interest. The aim of this writing is to express, immediately, its complete opposition on the grounds that this Agreement is not in accordance with the Law. Regardless of the above, this appeal is filed to request the adoption of the precautionary measure suspending the Agreement, in view of the special urgency and to avoid a set of irreversible damages as a result of the immediate enforceability of the Agreement, that even the favourable estimation of the appeal could not repair. In any case, it is developed through the Otrosí of this appeal, the three requirements that must met so that a precautionary measure can be adopted.
