El salvamento marítimo : hacia una acción conjunta de la Unión Europea

Abstract

La crisis de la gestión migratoria en la que se encuentra sumida la Unión Europea desde el año 2015 obedece, en parte, a la desproporción de la responsabilidad contraída por los países de la frontera sur de la Unión frente a la inmigración que llega a través del Mediterráneo. La peligrosidad en la utilización de la vía marítima hace necesaria una actuación específica por parte de la Unión. El salvamento marítimo constituye una obligación y la Unión Europea en su conjunto debe propender a que éste se realice conforme a las normas internacionales. El Nuevo Pacto sobre Migración y Asilo presenta algunas medidas relativas al salvamento marítimo, no obstante, resultan insuficientes debido, en parte, a que establece un sistema de solidaridad “flexible” en el reparto de la responsabilidad de la entrada irregular de migrantes por la costa mediterránea.

Since 2015 Europe has been facing a migrant crisis which has been handled inadequately by the European Union. This is partly due to the disproportionate share of the assigned burden falling on to the countries on the Union’s southern border with immigration influx coming from the Mediterranean. This route is dangerous and requires special action by the Union. Maritime rescue is obligatory and the European Union must strive for it to be performed in the most responsible manner, in accordance with international standards. The New Pact on Migration and Asylum presents insufficient measures to address this situation. This in part is linked to the disproportion and lack of solidarity that Mediterranean countries experience with burden-sharing brought to them by the irregular entry of migrants by sea.
