La crisis del derecho a la información veraz: un análisis jurídico moderadamente pesimista

Abstract

En un mundo que se mueve cada vez a mayor velocidad, no está de más recordar los cimientos del derecho a la información veraz, los mecanismos constitucionales existentes para su defensa y, en última medida, la propia evolución de la conducta de los ciudadanos, pues lo que es una amenaza bien puede convertirse en una oportunidad si se sabe aprovechar el inmenso caudal de datos que fluye a diario gracias a las nuevas tecnologías. Vale la pena reflexionar sobre las últimas sentencias judiciales sobre este particular y asumir que el mundo periodístico no volverá a ser el que era. Lo cual en sí no tiene por qué ser malo, pero sí puede parecer tremendamente peligroso. Sobre todo cuando comprobamos que se aprueban medidas de control de la información comunicada que hoy se entienden como salvadoras, pero que años atrás se habrían considerado absolutamente impensables, tales como una posible intervención del poder público a la hora de evaluar noticias y desinformaciones.

In a world that is moving ever faster, it is worth remembering the foundations of the right to truthful information, the existing constitutional mechanisms for its defence and, ultimately, the evolution of citizens' behaviour itself, because what is a threat may well become an opportunity if we know how to take advantage of the immense amount of data that flows daily thanks to new technologies. It is worth reflecting on recent court rulings on this issue and assuming that the journalistic world will never be the same again. This is not necessarily a bad thing in itself, but it can seem extremely dangerous. Particularly when we see that measures are being approved to control the information communicated which today are seen as saving the day, but which years ago would have been considered absolutely unthinkable, such as the possible intervention of the public authorities in the evaluation of news and misinformation.
