La protección legal de las obras en el mercado de NFTs

Abstract

En un intento de adaptación a los ritmos voraces que marca el mercado y las tendencias tecnológicas, la disciplina artística ha ido expandiendo sus limites hasta alcanzar una era en la que hablamos de arte digital como nueva forma de creación, que se caracteriza por la aplicación de la tecnología digital en su proceso productivo. Nacen así los NFT’s, que simbolizan la disrupción del arte como hasta ahora lo conocíamos; se trata de obras representadas a través de activos no fungibles, que poseen un contenido único e irrepetible.

No obstante, el pilar fundamental sobre el que se sustenta y se cotiza una obra de arte, además de su valor e importancia dentro de un contexto, sigue siendo el significado único que posee; es decir, todo lo que pueda diferenciar una pieza de otra cualquiera. Es por ello que la documentación de esta nueva forma de arte se ha convertido en un elemento fundamental para su conservación, y a la vez en uno de los principales retos a abordar. De este modo, profundizaremos en la creación de los NFT’s y en la aplicación de la tecnología blockchain para la protección de dichas obras. Se trata de un reto jurídico aun por abordar, y debido a la falta de regulación de la materia, intentaremos analizar el futuro de su recorrido desde un punto de vista legislativo, teniendo en cuenta la normativa tanto nacional como europea.

In an attempt to adapt to the voracious rhythms, set by the market and technological trends, the artistic discipline has been expanding its limits until reaching an era in which we speak of digital art as a new form of creation, characterized by the application of digital technology in its productive process. This is how NFT's were born, symbolizing the disruption of art as we knew it until now; these are works represented through non-fungible assets, which have a unique and unrepeatable content.

However, the fundamental pillar on which a work of art is based and priced, in addition to its value and importance within a context, is still the unique meaning it possesses; in other words, everything that can differentiate one piece from another. This is why the documentation of this new art form has become a fundamental element for its conservation, and at the same time one of the main challenges to be tackled. In this way, we will delve into the creation of NFTs and the application of blockchain technology for the protection of these works. This is a legal challenge yet to be addressed, and due to the lack of regulation of the matter, we will try to analyse the future of its path from a legislative point of view, taking into account both national and European regulations.
