Justicia restaurativa

Abstract

La Violencia de Género es un delito cada vez más reconocido en España, aún así, a día de hoy no se permite tratar esta tipología delictiva a través de la Justicia Restaurativa. Actualmente, el debate sobre si esta decisión es acertada o no, se puede seguir a través de numerosas fuentes de información. Este trabajo tiene como objetivo recabar información sobre la Violencia de Género en España, al igual que estudiar el concepto de Justicia Restaurativa para así exponer los diferentes argumentos a favor y en contra de implementar este modelo de justicia a los supuestos delictivos de Violencia de Género. Finalmente, se concluye que, con ciertos ajustes, la Justicia Restaurativa sí puede ser beneficiosa tanto para la víctima, como para el agresor, como para la comunidad.

Gender Violence is an increasingly recognized crime in Spain, but even so, at present it is not allowed to treat this type of crime through Restorative Justice. Currently, the debate on whether this decision is right or wrong can be followed through numerous sources of information. This paper aims to gather information on Gender Violence in Spain, as well as to study the concept of Restorative Justice in order to expose the different arguments for and against implementing this model of justice to the criminal assumptions of Gender Violence. Finally, it is concluded that, with certain adjustments, Restorative Justice can be beneficial for the victim, the aggressor, and the community.
