Justicia restaurativa

Abstract

En el período comprendido entre la Guerra Civil española y la Dictadura Franquista se cometieron delitos que violaban los derechos humanos. La nación quedó marcada por una victoria del bando sublevado y cubierta por el manto de la impunidad ante dichos delitos, esto gestó en las víctimas un encapsulamiento de su dolor. Dentro del segmento olvidado y represaliado, se encuentra un escalafón inferior: las mujeres. La imposición de una ideología provocó que el trauma se alojase en el inconsciente familiar, transmitiéndose de generación en generación. Para reconquistar la narrativa y que la primera persona esté ocupada por la mujer, se ha de configurar una memoria colectiva con el fin de reparar una herida que todavía hoy sigue abierta y reconciliar una nación fragmentada. La sanación equidista de la justicia restaurativa que pone el acento en medidas específicas llevadas a cabo por el Estado, al ser insuficiente o parcialmente reparadoras, se pone de relieve la necesidad de implicación individual.

In the period between the Spanish Civil War and the Franco dictatorship, crimes were committed that violated human rights. The nation was marked by the victory of the rebel side and covered by the mantle of impunity for these crimes, which caused the victims to encapsulate their pain. Within the forgotten and repressed segment, there is a lower echelon: women. The imposition of an ideology caused the trauma to become lodged in the family unconscious, being transmitted from generation to generation. In order to reconquer the narrative and for the first person to be occupied by women, a collective memory has to be shaped in order to repair a wound that is still open today and reconcile a fragmented nation. The equidistant healing of restorative justice that emphasises specific measures carried out by the state, being insufficient or partially restorative, highlights the need for individual involvement.
