dc.description.abstract | Este trabajo tiene por finalidad analizar el concepto y la clasificación jurídica de los Tokens no fungibles con respecto a la propuesta de Reglamento MiCA y la regulación de los instrumentos financieros. La industria de los criptoactivos ha experimentado un gran crecimiento y visibilidad estos últimos años. Con respecto a los NFTs, existe una gran incertidumbre jurídica, ya que son excluidos y relegados a un segundo plano por parte del regulador, tanto a nivel comunitario como nacional. El objetivo último de este TFG es analizar la clasificación jurídica del NFT, con especial atención al concepto de fungibilidad en el ámbito jurídico y la consideración de estos activos como bienes no fungibles. A su vez, se analiza la normativa aplicable con relación a la clasificación jurídica del NFT como bien fungible o no fungible . En este trabajo analizaremos el concepto y las características de los NFTs y la postura del legislador respecto a estos activos, para posteriormente determinar la clasificación jurídica del NFT y las implicaciones jurídicas de su naturaleza. Respecto a las implicaciones jurídicas, el trabajo se centra en la posible consideración de estos criptoactivos como valores negociables y cómo afecta la fungibilidad en las formas de reparación del daño. | es-ES |
dc.description.abstract | The purpose of this paper is to analyze the concept and legal classification of NFTs with respect to the MiCA Regulation and the regulation of financial instruments. The cryptoassets industry has experienced great growth and visibility in recent years. With respect to NFTs, there is legal uncertainty, as they are excluded by the regulator, both at EU and national level. The objective of this work is to analyze the legal classification of NFTs, with special attention to the concept of fungibility in the legal field and the consideration of these assets as non-fungible goods. In addition, the regulations applicable to the legal classification of NFT as fungible or non-fungible goods are analyzed. In this paper we will analyze the concept and characteristics of NFTs and the legislator's position with respect to these assets, to later determine the legal classification of NFTs and the legal implications of their nature. Regarding the legal implications, the paper focuses on the possible consideration of these cryptoassets as tradable securities and how fungibility affects the forms of damage reparation. | en-GB |
