El derecho de usufructo del cónyuge viudo. Especial mención a la cautela sociniana

Abstract

El derecho de usufructo legal para el cónyuge viudo en España es el único derecho de usufructo establecido por la ley. Este derecho tiene implicaciones importantes y es necesario prestarle atención. El cónyuge viudo es considerado como heredero forzoso en la herencia del causante, lo que conlleva derechos y obligaciones especiales, ya que su derecho no supone una sustitución en la posición del fallecido. Mi Trabajo Fin de Grado se enfoca en analizar exhaustivamente todos los aspectos relacionados con el usufructo legal del cónyuge viudo con una especial mención a la Cautela Sociniana. Es la ley civil la que regula esta figura jurídica, aunque en algunos casos haya requerido la interpretación de la jurisprudencia.

The legal right of use and enjoyment for the widowed spouse in Spain is the only right of use and enjoyment established by law. This right has important implications and requires attention. The widowed spouse is considered the forced heir in the inheritance of the deceased spouse, which involves special rights and obligations, as their right does not imply a substitution in the position of the deceased. My Final Degree Project focuses on thoroughly analyzing all aspects related to the legal right of use and enjoyment for the widowed spouse, with special mention to the Socinian Custody. It is the civil law that regulates this legal figure, although in some cases it has required the interpretation of jurisprudence.
