La participación en los delitos contra la libertad sexual

Abstract

La participación en los delitos contra la libertad sexual lleva siendo objeto de debate doctrinal desde hace décadas. La naturaleza de este tipo de delitos como delitos de propia mano ofrece dudas en cuanto a los elementos y supuestos que integran la conducta típica. En el presente trabajo se analiza la evolución jurisprudencial que ha tenido esta cuestión, en relación con distintas formas participativas, así como otras problemáticas que se han suscitado al respecto. El análisis se realiza teniendo en cuenta la regulación de los delitos sexuales en el Código Penal español, anterior y posterior a la reforma por la Ley Orgánica 10/2022 de garantía integral de la libertad sexual, y la teoría jurídica del delito al respecto de la participación.

Participation in sexual offences has been an issue for doctrinal debate since decades. The notion that these types of crimes can only be committed directly and personally by the offender has raised doubts as to the elements and cases which can integrate the criminal action. This research work consists of the analysis of jurisprudential evolution regarding this particular matter, in relation with different forms of participation, as well as the analysis of other issues which have arised in this respect. Said analysis is done taking into consideration the regulation of sexual offences in the Spanish Penal Code, before and after the amendment by the LO 10/2022 of complete guarantee of sexual liberty, and legal crime theory regarding participation.
