EL INGRESO MÍNIMO VITAL COMO INSTRUMENTO DE LA ACTIVIDAD DE FOMENTO DE LA ADMINISTRACIÓN PÚBLICA. UN ESTUDIO SOBRE LA RELACIÓN ENTRE EL ESTADO SOCIAL Y EL ESTADO GARANTE EN EL SISTEMA JURÍDICO ESPAÑOL

Abstract

La Ley 19/2021, de 20 de diciembre, configura al Ingreso Mínimo Vital como un nuevo derecho subjetivo de la ciudadanía española cuyo objetivo, ante el contexto de crisis económico social iniciado por la pandemia Covid-19, es cubrir unas condiciones materiales básicas a particulares y familias que se encuentren en una situación de vulnerabilidad económica a fin de fomentar la lucha contra la pobreza y la exclusión social. Como parte del brazo no contributivo de la Seguridad Social, la constitución de esta nueva prestación ha supuesto una disrupción significativa para la Administración Pública y, por ende, ha requerido una reordenación del sistema de protección social que le precedía, especialmente las prestaciones asistenciales de las Comunidades Autónomas conocidas como “Rentas Mínimas de Inserción”. Todo ello, en el marco de la paradigmática transformación del Estado social prestacional al Estado garante, señalada por la doctrina administrativa desde hace ya décadas, que acaba por generar expectación de cara a una eventual reversión de dicho modelo ante el surgimiento de la nueva prestación. Así, el presente trabajo marca como objetivos representar y evaluar la actual configuración legal del Ingreso Mínimo Vital desde la óptica del Derecho Administrativo, basándose el análisis jurídico en la legislación vigente, la jurisprudencia de nuestro Alto Tribunal y la doctrina de los autores más relevantes en la materia. Con ese propósito, se presentarán las cuestiones más problemáticas que rodean al Ingreso Mínimo Vital y sus posibles soluciones junto a un estudio del encuadramiento de la prestación en el Estado social garante y la motivación inherente que llevó al legislador a establecer un innovador mecanismo del Estado social.

Law 19/2021, of 20 December, configures the Minimum Vital Income as a new subjective right of Spanish citizens whose objective, in the context of the social economic crisis initiated by the Covid-19 pandemic, is to cover basic material conditions for individuals and families in a situation of economic vulnerability in order to promote the fight against poverty and social exclusion. As part of the non-contributory arm of the Social Security system, the creation of this new benefit has meant a significant disruption for the Public Administration and, therefore, has required a restructuring of the social protection system that preceded it, especially the welfare benefits of the Autonomous Communities known as "Rentas Mínimas de Inserción" (Minimum Insertion Income). All of this, within the framework of the paradigmatic transformation of the social welfare State into a guarantor State, as pointed out by the administrative doctrine for decades now, which has generated expectations of an eventual reversal of this model in the face of the new benefits that have arisen. Thus, the objectives of this paper are to represent and evaluate the current legal configuration of the Minimum Vital Income from the perspective of Public Administration Law, basing the legal analysis on current legislation, the case law of our High Court and the doctrine of the most relevant authors on the subject. To this end, the most problematic issues surrounding the Minimum Vital Income and their possible solutions will be presented, together with a study of the framing of the allowance in the guarantor social State and the inherent motivation that led the legislator to establish an innovative mechanism of the social State.
