Origen y fundamento del derecho internacional en el pensamiento de Fray Francisco de Vitoria, O.P.

Abstract

Al acercarnos al estudio del Derecho Internacional, se nos presenta una exigencia primera en la actividad intelectual y académica. Antes de adentrarse en el estudio particular de las fuentes de esta rama del Derecho o antes de intentar comprender las relaciones del Derecho Internacional con los diferentes sistemas jurídicos de los Estados, es de obligación atender a una cuestión primera: cuáles son los puntos de partida, es decir, cuáles son los fundamentos en los que se asienta o, al menos, en los que debería hundir sus cimientos, el Derecho Internacional.

Esta pregunta primera por el origen y fundamento del Derecho Internacional puede ser respondida desde muchas perspectivas, cosmovisiones o autores. Para dar respuesta a esta pregunta se estudiará aquí a un autor en concreto, muchas veces considerado el padre del Derecho Internacional: Fray Francisco de Vitoria, O.P.

Este autor, entroncado en lo más profundo de la Escolástica española del siglo XVI, figura clave de la Escuela de Salamanca, arroja una clara luz sobre la pregunta primera que quieren afrontar las páginas que siguen. Para ello, se estudiarán las fundamentaciones antropológicas, filosóficas y teológicas de su pensamiento respecto al Derecho Internacional para analizar después en profundidad las fundamentaciones políticas y jurídicas de sus planteamientos. Finalmente parece pertinente preguntarse por la validez y actualidad de su pensamiento a día de hoy.

When approaching the study of International Law, we are presented with a first requirement in the intellectual and academic activity. Before entering into the particular study of the sources of International Law or before trying to understand the relations of International Law with the different national legal systems, it is of obligation to attend to a first question: what are the starting points, that is, what are the foundations on which International Law is (or should be) based.

This first question about the origins and foundations of international law can be answered from many perspectives, worldviews or authors. In order to answer this question, a specific author will be studied here, an author that is often considered the father of International Law: Fr. Francisco de Vitoria, O.P.

This author, deeply rooted in the Spanish Scholasticism of the 16th century, a key figure of the School of Salamanca, offers a clear light on the issues that the following pages seek to address. To this end, the anthropological, philosophical, and theological foundations of his thought on international law will be studied, followed by an in-depth analysis of the political and legal foundations of his thought. Finally, it seems relevant to ask ourselves about the validity and relevance of his thinking today.
