Análisis parlamentario de la Ley Constitutiva del Ejército de 1878 : del Ejército ilustrado al liberal

Abstract

El Ejército del siglo XIX presentaba una importancia fundamental en la vida política española, por lo que un objetivo prioritario de la Restauración fue reestructurar la institución, regulada de forma muy fragmentada hasta la fecha, mediante la Ley Constitutiva del Ejército de 1878. En el presente trabajo, se realiza un análisis de la tramitación parlamentaria de esta ley, exponiendo las claves del proceso en ambas cámaras, y profundizando en los puntos de mayor interés. Así, se estudiará la figura del Rey y su compleja vinculación con el Ejército, se debatirán los derechos del personal militar, las modificaciones relativas a la estructura del Ejército en todos los niveles y cómo la obediencia debida puede ayudar o perjudicar a la defensa de la Constitución. En estas páginas pretende demostrarse la gran importancia que tuvo esta ley y los profundos debates que llevaron a aprobarla, que tratan cuestiones tan apasionantes y diversas como la separación de poderes, la seguridad de la Constitución, el respeto a los derechos fundamentales y las particularidades militares y territoriales de España.

The Army of the 19th century was of fundamental importance in Spanish political life. Hence, a priority objective of the Restoration was to restructure the institution, regulated in a very fragmented way to date, by the Constitutive Law of the Army of 1878. At present work, an analysis of the parliamentary processing of this law is carried out, exposing the keys of the process in both chambers, and delving into the points of most significant interest. Thus, the figure of the king and his complex relationship with the army will be studied, the rights of military personnel and modifications related to the structure of the army at all levels will be discussed, and it will be asked how due obedience can help or harm the defense of the Constitution. These pages intend to demonstrate the great importance of this law and the profound debates that led to its approval, which deal with such exciting and diverse issues as the separation of powers, defense of the Constitution, respect for fundamental rights and military and territorial particularities of Spain.
