Abstract

En el presente informe se procede a analizar en calidad de asesor jurídico las cuestiones planteadas en la operación de edificación que se nos ilustra. El informe en su mayoría versará sobre el proceso de ventilar las cuestiones de responsabilidad que se nos presentan, las cuales giran en torno a una serie de contingencias que aparecen a lo largo de la edificación. A lo largo del informe, se tratará en profundidad el sistema de responsabilidad civil extracontractual, el sistema de responsabilidad por accidentes laborales, así como el propio sistema de responsabilidad inherente al proceso de edificación, el cual ostenta su propia normativa, así como un gran desarrollo jurisprudencial. En dicha normativa, se tratará de identificar correctamente a cada uno de los agentes intervinientes en la construcción, aspecto clave a la hora de lograr la individualización de responsabilidades. Por último, el informe concluirá respondiendo una serie de consultas en lo que respecta a la financiación de la operación, donde se tratarán aspectos de la intermediación en los contratos de financiación inmobiliaria, así como aspectos en el sistema de garantías de los mismos.

In this report we proceed to analyze as legal counsel the issues raised in the building operation illustrated to us. The report will mostly deal with the process of solving the liability issues presented to us, which revolve around a series of contingencies that appear throughout the building operation. Throughout the report, we will deal in depth with the tort liability system, the system of injury liability for workplace accidents, as well as the liability system inherent to the building process, which has its own regulations, as well as a great jurisprudential development. In these regulations, we will try to correctly identify each of the agents involved in the construction process, a key aspect when it comes to the individualization of responsibilities. Finally, the report will conclude by answering a series of queries regarding the financing of the operation, where aspects of intermediation in real estate financing contracts will be dealt with, as well as aspects in the guarantee system of them.
