Abstract

En este libro se realiza un tratamiento claro, comprensible, lógico y sistemático del Derecho de Obligaciones y Contratos. Su objetivo es ser una herramienta eficaz para aprender, comprender, analizar y reflexionar sobre el Derecho civil. Se divide en cuatro partes: Teoría General de la Obligación, Teoría General del Contrato y Contratos, Cuasicontratos y Responsabilidad civil extracontractual , siguiendo la estructura clásica para el estudio y análisis de esta parte del Derecho civil. Cada capítulo se abre con un esquema inspirado en las modernas técnicas de los cuadros sinópticos y mapas conceptuales. Pueden servir tanto para de un vistazo ver lo que se trata en cada capítulo, como para aclarar y facilitar la comprensión e incluso el estudio del Derecho de Obligaciones y Contratos. Se ha intentado que el texto de cada capítulo esté redactado de forma ágil y amena con ejemplos allí donde son necesarios. La cita de jurisprudencia es amplia tanto en cantidad, como en extensión, cuando parece interesante reflejar lo que la sentencia dice para que el lector se forme correctamente una opinión. Por último, al final de cada capítulo hay una Bibliografía recomendada que es accesible para cualquier estudioso de la materia. Como se verá, se presenta una Bibliografía recomendada general. La Bibliografía recomendada general no es un catálogo de Elementos, Sistemas y Tratados de Derecho civil, ni todos los tomos que en ella se recogen tratan de forma general la materia objeto de este libro. Se trata de obras que pueden ser útiles para profundizar en varios capítulos, por lo que aconsejo comenzar siempre por esta bibliografía general, seleccionando lo que pueda servir para el propósito particular que se esté analizando y, después, pasar a la Bibliografía recomendada particular de cada Capítulo. Además, las obras que se recogen en la Bibliografía general no las he «despiezado», de tal forma que, por ejemplo, los Comentarios al CC servirán para muchos de los Capítulos del libro y no he ido poniendo en cada Capítulo una referencia a esa parte de la Obra citada en la Bibliografía General.

This book provides a precise, understandable, logical, and systematic treatment of the Law of Obligations and Contracts. Its objective is to be an effective tool for learning, understand, analyzing, and reflecting on civil law. It is divided into four parts: General Theory of Obligation, General Theory of Contract, Contracts, Quasi-contracts, and Torts, following the classical structure for the study and analysis of this part of civil law. Each chapter opens with an outline inspired by the modern techniques of synoptic tables and concept maps. They can both see what is discussed in each chapter and clarify and facilitate the understanding and even the study of the Law of Obligations and Contracts. We have tried to ensure that the text of each chapter is written in an agile and enjoyable way with examples where they are needed. The citation of jurisprudence is broad both in quantity and in extension when it seems interesting to reflect what the judgment says so that the reader correctly forms an opinion. Finally, at the end of each chapter, there is a recommended bibliography that is accessible to any student of the subject. As will be seen, a general recommended bibliography is presented. The General Recommended Bibliography is not a catalog of Elements, Systems, and Treaties of Civil Law, nor do all the volumes contained therein deal in a general way with the subject matter of this book. These works can be helpful to deepen several chapters, so I advise you to always start with this available bibliography, selecting what can serve the particular purpose being analyzed, and then move on to the specifically recommended bibliography of each Chapter. In addition, the works that are collected in the General Bibliography I have not "cut them apart" so that, for example, the Commentaries to the CC will serve for many of the book's Chapters. I have not been putting in each Chapter a reference to that part of the Work cited in the General Bibliography.
