Las cláusulas abusivas en los préstamos hipotecarios

Abstract

En el presente Trabajo se tratará de abarcar el tema de las cláusulas abusivas en los préstamos hipotecarios, atendiendo a los recientes cambios en nuestro ordenamiento jurídico, así como en la jurisprudencia de nuestros Tribunales. Comenzaremos desde el análisis de las cláusulas abusivas como concepto amplio del término, para ir adentrándonos en profundidad en las cláusulas abusivas en los préstamos hipotecarios, así como su imposibilidad de inscripción de éstas en el Registro de la Propiedad correspondiente.

In the present Work, will be to include the subject of the abusive clauses in the mortgage loans, taking care of the recent changes in our legal system, as well as in the jurisprudence of our Courts. We will begin from the analysis of the abusive clauses, like an ample concept of the term, to be entering to us in the abusive clauses in the mortgage loans, as well as their impossibility of inscription of these in the corresponding Registry of the Property.
