El delito de odio en el Código Penal Español

Abstract

El presente trabajo tiene por objeto abordar el fenómeno del odio y su relevancia penal desde una perspectiva jurídica, con un enfoque específico en España. Para ello se establece el marco conceptual necesario, definiendo el odio y delimitando su ámbito respecto a los delitos de odio, el discurso de odio y su relación con la libertad de expresión. Además, se hace un análisis de la evolución del tratamiento legal del odio en España a través de las modificaciones legislativas en el Código Penal desde 1995. El núcleo del trabajo consiste en un análisis penal y jurisprudencial de los delitos de odio contenidos en el artículo 510 del Código Penal, en donde se destacan las características comunes de estos ilícitos y se detallan las conductas típicas contempladas en cada apartado. A través de este trabajo, se busca ofrecer una comprensión profunda y detallada de los delitos de odio en el contexto legal español, contribuyendo al debate académico y jurídico sobre este tema de creciente importancia.

This paper aims to address the phenomenon of hate and its criminal relevance from a legal perspective, with a specific focus on Spain. To this end, the necessary conceptual framework is established, defining hate and delimiting its scope with respect to hate crimes, hate speech and its relationship with freedom of expression. In addition, an analysis is made of the evolution of the legal treatment of hate in Spain through the legislative modifications to the Criminal Code since 1995. The core of the work consists of a criminal and jurisprudential analysis of the hate crimes contained in article 510 of the Criminal Code, highlighting the common characteristics of these offences and detailing the typical conducts contemplated in each section. The aim of this work is to offer a deep and detailed understanding of hate crimes in the Spanish legal context, contributing to the academic and legal debate on this increasingly important issue.
