La Amnistía para los condenados por “el procés”: un análisis de su constitucionalidad

Abstract

Los rumores sobre una ley de amnistía en el ordenamiento jurídico español han trascendido de un propuesta teórica a una realidad tangible, generando un gran debate en diversos ámbitos de la sociedad, incluyendo la esfera civil, política y jurídica. Este trabajo tiene como objetivo no solo explorar sino también profundizar en la compleja diversidad de posturas y opiniones que rodean la cuestión de la constitucionalidad de esta figura jurídica. Con este fin, se realizará un análisis detallado y crítico de los diversos argumentos presentados tanto a favor como en contra. Diversos órganos nacionales e internacionales, al igual que juristas de reconocido prestigio han dado y fundamentado sus opiniones al respecto. Se analizará particularmente, si a pesar de la ausencia explícita de la amnistía en el artículo 62.i) de la Constitución Española, esta figura jurídica encuentra un espacio legítimo dentro del ordenamiento jurídico español. Asimismo, se estudiará si la figura de la amnistía se alinea con los estándares y principios fundamentales de un Estado de Derecho, evaluando meticulosamente su conformidad y coherencia con los valores y principios establecidos en la Constitución Española. De esta manera, el estudio aspira a contribuir significativamente al debate existente, proporcionando una visión exhaustiva que permita una comprensión más rica.

Rumors about an amnesty law in the Spanish legal system have transcended from a theoretical proposal to a tangible reality, generating a significant debate in various spheres of society, including the civil, political, and legal realms. This work aims not only to explore but also to delve into the complex diversity of positions and opinions surrounding the issue of the constitutionality of this legal figure. To this end, a detailed and critical analysis of the various arguments presented both in favor and against will be conducted. Various national and international bodies, as well as renowned jurists, have given and substantiated their opinions on the matter. It will be particularly analyzed whether, despite the explicit absence of amnesty in article 62.i) of the Spanish Constitution, this legal figure successfully finds a legitimate space within the Spanish legal system. In addition, it will be examined if the figure of amnesty aligns with the standards and fundamental principles of a Rule of Law, meticulously evaluating its compliance and coherence with the values and principles established in the Spanish Constitution. In this way, the study aspires to contribute significantly to the existing debate, providing a comprehensive vision that allows for a richer understanding.
