Abstract

Esta investigación va enfocada al análisis exhaustivo de la agresión en menores en los últimos diez años. Este delito tipificado en el Código Penal y nuestro enfoque comprenderá no únicamente sus factores criminológicos sino además un meticuloso análisis jurisprudencial y penal, con la finalidad de arrojar luz sobre su complicada naturaleza y sus efectos en el ámbito legal. Con este Trabajo Fin de Grado se pretende realizar una aproximación más adecuada en torno a las sanciones y penas impuestas en España a todos los agresores y atender a las consecuencias jurídicas aplicables derivadas de la última reforma, que tuvo lugar en el año 2022-2023. Por otra parte, el presente estudio explorará aquellas cuestiones referentes al perfil del agresor, sus tácticas y los contextos en los que estos delitos tienden a perpetrarse con mayor frecuencia, así como en los ámbitos en los que no es tan notorio y visible, como el entorno intrafamiliar. Por último, se hará referencia e hincapié en los dificultades e impedimentos a los que se exponen las víctimas, puesto que en múltiples ocasiones pueden mostrarse reticentes a presentar una denuncia.

This research is focused on the exhaustive analysis of both aggression and sexual abuse in minors in the last ten years. Both are crimes classified in the Penal Code and our approach will include not only their criminological factors but also a meticulous jurisprudential and criminal analysis, in order to shed light on their complicated nature and their effects in the legal field. This Final Degree Project aims to make a more appropriate approach to the sanctions and penalties imposed in Spain on all aggressors and to address the applicable legal consequences derived from the last reform, which took place in the year 2022-2023. In addition, we will examine sentences, as well as the effectiveness and efficacy of the law in cases of this nature. In this way, both the justice and equity of said penalties can be assessed in alleviating recidivism. On the other hand, the present study will explore those questions regarding the profile of the aggressor, his tactics and the contexts in which these crimes tend to be perpetrated more frequently, as well as in the areas in which it is not so noticeable and visible, such as intrafamilial environment. Finally, reference and emphasis will be made to the difficulties and impediments to which victims are exposed, since on many occasions they may be reluctant to file a complaint.
