La legítima. Análisis de las consecuencias jurídicas y sociales de su supresión

Abstract

El sistema legitimario en España, que se ha mantenido en cuanto al Derecho Civil Común (con ciertas modificaciones) desde la promulgación del Código Civil en 1889, responde a las necesidades de una sociedad que ha experimentado significativas transformaciones en la estructura familiar y en sus dinámicas afectivas y económicas. En su origen, la limitación en la libertad de testar estaba respaldada por una concepción tradicional de la familia (basada en la protección recíproca y en la convivencia), pero la drástica evolución de la noción de la familia en los últimos años hace que se cuestione la pertinencia del sistema legitimario establecido.

Con el presente Trabajo de Fin de Grado se pretende examinar en profundidad el sistema legitimario español, desde su origen histórico hasta su fundamento actual, y analizar su adecuación a las necesidades de la sociedad contemporánea. Se explorarán las posibles repercusiones jurídicas y sociales de la supresión de las legítimas en el Derecho Común y se incluirá, a modo de propuesta, un posible sistema alternativo en el ámbito sucesorio basado en un derecho de alimentos post mortem.

La elección de este tema se fundamenta en su relevancia y actualidad en el ámbito del Derecho Sucesorio, donde la supresión de las legítimas genera debate y opiniones encontradas.

The succession system in Spain, which has been maintained in terms of Common Civil Law (with certain modifications) since the promulgation of the Spanish Civil Code in 1889, responds to the needs of a society that has undergone significant transformations in the family structure and in its affective and economic dynamics. Originally, the limitation on the testamentary freedom was supported by a traditional conception of the family (based on reciprocal protection and cohabitation), but the drastic evolution of the notion of the family in recent years calls into question the relevance of the established legitimacy system.

The aim of this Final Degree Project is to examine in depth the Spanish succession system, from its historical origin to its current foundation, and to analyze its adaptation to the needs of contemporary society. It will explore the possible legal and social repercussions of the suppression of the succession system in the Common Civil Law and will include, as a proposal, a possible alternative system in the field of inheritance based on a postmortem right of maintenance.

The choice of this topic is based on its relevance and importance in the field of inheritance law, where the suppression of the limitations on the testamentary freedom generates debate and conflicting opinions.
