La Constitución Española de 1931, el paso del mito al logos.

Abstract

Pocos son los elementos que tienen los españoles para entender, sin versiones ideales ni infernales, lo que aconteció en España en los años previos a la Guerra Civil. Y son mucho menores las herramientas que tienen los juristas para acercarse al fenómeno de la Segunda República Española. Mientras, como una nube en el horizonte, se cierne sobre nosotros una tormenta (en forma de pregunta) que ya ha arremetido en otras ocasiones: “¿Monarquía o República?”.

El presente trabajo, inspirado por el libro “Entre la Segunda y la Tercera República”, del catedrático y D. Alejandro Nieto, busca analizar jurídicamente el texto constitucional de 1931 y sus elementos más importantes (modelo territorial, derechos políticos, sistema electoral, etc.) para determinar su calidad jurídica y la relación directa que tuvo con los acontecimientos más importantes de aquellos años. Posteriormente, determinar en qué grado el marco jurídico establecido por la Constitución propició o agravó ciertos conflictos, y averiguar si este texto constitucional condenó a la República a fracasar y a los españoles a la Guerra Civil. Y, en última instancia, dotar a los ciudadanos y juristas de una herramienta de análisis que les permita responder con sentido crítico a la pregunta cuando llegue el momento.

Como se ha mencionado previamente, «los hechos son conocidos ciertamente hasta en sus últimos detalles, pero su sentido sigue siendo un enigma sujeto a las interpretaciones más diversas» (Nieto, 2022). Hoy, inspiran el presente escrito la necesidad y determinación de atreverse a bucear en una verdad que debemos conocer. Aquí reside la misión y sed de verdad a la que este Trabajo de Fin de Grado busca dar respuesta; aunque las versiones estén mezcladas y nos hayamos acostumbrado a trabajar con aquellas falsedades que parecen ciertas, siempre tendremos la posibilidad (e incluso el deber), como nos recordaba Hesíodo, de contar lo verdadero.

Few elements are available to Spaniards to understand, without idealized or hellish versions, what happened in Spain in the years leading up to the Civil War. And even fewer are the tools available to jurists to approach the phenomenon of the Second Spanish Republic. Meanwhile, like a cloud on the horizon, a storm looms over us (in the form of a question) that has already struck on other occasions: "Monarchy or Republic?"

This work, inspired by the book “Between the Second and the Third Republic” by Professor Alejandro Nieto, seeks to legally analyze the constitutional text of 1931 and its most important elements (territorial model, political rights, electoral system, etc.) to determine its legal quality and the direct relationship it had with the most important events of those years. Subsequently, it aims to determine to what extent the legal framework established by the Constitution contributed to or aggravated certain conflicts, and to find out if this constitutional text condemned the Republic to fail and the Spaniards to the Civil War. Ultimately, it seeks to provide citizens and jurists with an analytical tool that allows them to critically answer the question when the time comes.

As previously mentioned, "the facts are certainly known down to their last details, but their meaning remains an enigma subject to the most diverse interpretations" (Nieto, 2022). Today, this writing is inspired by the necessity and determination to dare to delve into a truth that we must know. Herein lies the mission and thirst for truth to which this Final Degree Project seeks to respond; although the versions are mixed and we have become accustomed to working with those falsehoods that seem true, we will always have the possibility (and even the duty), as Hesiod reminded us, to tell the truth.
