Resumen: El trabajo examina el Estado Constitucional y Democrático de Derecho, centrando su análisis en España y la UE, particularmente en la independencia judicial y los retos del Estado de Derecho en Polonia y Hungría. Aborda la historia y características del Estado de Derecho, la importancia de la Constitución, y cómo el Estado Democrático de Derecho equilibra la autoridad estatal con la protección de los derechos individuales y la participación ciudadana. Utiliza una metodología cualitativa y comparativa, examinando la jurisprudencia y legislación relevante para comprender cómo se aplican y desafían estos principios en la práctica.
