INTELIGENCIA ARTIFICIAL Y SU IMPACTO EN EL ESTADO DE DERECHO

Abstract

Los avances en la ciencia y los cambios sociales han ido históricamentede la mano, suponiendo las grandes revoluciones tecnológicas autenticas reestructuraciones de las sociedades humanas. Siendo el Derecho el principal agente regulador de la vida en sociedad, no es de extrañarque éste y elprogreso tecnológico esténestrechamente vinculados, sobre todo si se tiene en cuenta el papel que debe jugar la ley en el Estado deDerecho al establecer los límites y reglas que rigenel desarrollocientífico.En este siglo XXI caracterizado por la omnipresencia de la tecnología en una sociedad global, llama especial atenciónel desarrollo del campo de investigaciónde la Inteligencia Artificial. Debido a las diversas maneras en las que puede implementarse la Inteligencia Artificial en la sociedad, y a las cuestiones éticas y filosóficas que su propia conceptualización plantea, se emprende esta investigacióncon el objetivo de estudiar las maneras en las que el desarrollo de las tecnologíasde Inteligencia Artificialpuedeafectar a la configuración actual del Estado de Derecho, asícomo los mecanismos éticosy normativos que este tendráque desarrollar para asegurar que la implantacióndeestas herramientas no perjudica a los ciudadanos en el ejercicio de sus derechos y libertades.

Advances in science and social changes have historically gone hand in hand, with major technological revolutions leading to significant restructuring of human societies. As the primary regulatory agent of societal life, it is not surprising that law and technological progress are closely linked, especially considering the role that law must play in the rule of law by establishing the limits and rules that govern scientific development. In this 21st century, characterized by the omnipresence of technology ina global society, special attention is drawn to the development of the field of Artificial Intelligence research. Due to the various ways in which Artificial Intelligence can be implemented in society, and the ethical and philosophical questions its very conceptualization raises, this research is undertaken with the objective of studying the ways in which the development of Artificial Intelligence technologies can affect the current configuration of the rule of law, as well as the ethical and regulatory mechanisms that will need to be developed to ensure that the implementation of these tools does not harm citizens in the exercise of their rights and freedoms.
